California ADU Laws 2026 — Complete Homeowner Guide

Quick answer: AB 3182 prohibits California HOAs from banning ADU or JADU construction on member properties or imposing standards stricter than state law — a Santa Monica or Pasadena homeowner has saved $20,000–$50,000+ per project as impact fees became proportional to actual ADU demand rather than a flat citywide fee. APLA Construction (CA Lic #1136359) stays current on California ADU law so your project is designed around it from the start.

California ADU Laws 2026 – Complete Homeowner Guide

California has the most permissive ADU laws in the United States. Since 2017, the state legislature has passed a series of bills that systematically eliminated barriers to ADU construction – limiting what cities can require, capping fees, mandating fast permit timelines, and prohibiting HOAs from blocking ADUs. This guide covers the current state of California ADU law as of 2026 so you know your rights before you start the process.

Key California ADU Laws in Effect (2026)

How Many ADUs Can I Build on My Property?

On a single-family lot you can build:

On a multi-family lot, the rules changed materially in 2025. Under SB 1211, effective January 1, 2025, you can build up to eight detached ADUs — with one hard limit: the number of detached ADUs can never exceed the number of residential units already on the lot. A four-unit building can add four; a thirty-unit building is still capped at eight. That is in addition to the long-standing right to convert up to 25% of existing non-livable space (storage rooms, boiler rooms, unused hallways, garages) into ADUs.

If anyone quotes you a two-detached-ADU maximum on a multifamily lot, they are working from pre-2025 guidance. Two was the old cap; it was replaced more than a year ago.

SB 1211 — What Changed for Multifamily Properties (Effective January 1, 2025)

SB 1211 is the most significant ADU law change for Los Angeles apartment and duplex owners in years, and it is still widely misunderstood. Three provisions matter:

For an LA fourplex with a detached garage row, the practical effect is large: the garages can come down, four detached ADUs can go up in their place, and no parking has to be rebuilt. If you own multifamily property in Greater LA and last looked at ADU feasibility before 2025, the answer you got then is no longer the answer today. ADU Size Limits in California

ADU Setback Requirements

State law limits how restrictive cities can be with setbacks:

ADU Height Limits

State law sets the minimum height a city must allow, not a maximum (Gov. Code § 66321(b)(4), as amended by SB 543 effective January 1, 2026):

Cities can allow more. The City of Los Angeles allows a detached ADU of up to 1,200 sq ft to be two stories within the zone’s height limit — see our two-story ADU guide.

Owner-Occupancy Requirements

You are not required to live on the property to build or rent out an ADU. The earlier temporary ban on owner-occupancy rules was due to expire in 2025; AB 976 (2023) made it permanent from January 1, 2024 (Gov. Code § 66315). Junior ADUs are treated differently: since January 1, 2026 (AB 1154), a city can require owner-occupancy for a JADU only if it shares bathroom facilities with the main house, and a JADU may be rented only for terms longer than 30 days (Gov. Code § 66333).

ADU Permit Timeline – State Mandate

California state law requires local agencies to approve or deny ADU permit applications within 60 days of receiving a complete application. If the agency fails to act within 60 days, the application is deemed approved. This law has dramatically accelerated ADU permitting across all LA jurisdictions.

Impact Fees for ADUs

State law restricts the fees cities can charge for ADU construction:

This law has saved ADU builders $20,000-$50,000+ per project in markets where impact fees were previously high (Santa Monica, Pasadena).

HOA Rules and ADUs in California

AB 3182 (effective January 1, 2021) prohibits HOAs from:

However, HOAs can still enforce architectural standards (exterior materials, colors, roof pitch, style) that are reasonable and consistently applied. The HOA cannot say no – but it can say what the ADU must look like. APLA reviews HOA CC&Rs for every ADU project to navigate this balance.

ADU Financing – SB 9 and CalHFA

Several state programs exist to help homeowners finance ADU construction:

Frequently Asked Questions – California ADU Laws 2026

How many ADUs can I build on a multifamily property in California?

Up to eight detached ADUs, but never more than the number of residential units already on the lot — so a four-unit building can add four, and a large building is still capped at eight. This limit took effect January 1, 2025 under SB 1211, which replaced the previous cap of two. You can also convert up to 25% of the building’s existing non-livable space into additional units on top of that.

Can my HOA prevent me from building an ADU in California?

No. AB 3182 prohibits HOAs from banning ADUs. Your HOA can regulate the design and appearance of the ADU, but it cannot prevent you from building one. If your HOA denies an ADU application, that denial is unenforceable under California law.

Do I have to live on the property to build or rent an ADU in California?

No. State law permanently bars cities from requiring owner-occupancy for an ADU (Gov. Code § 66315, made permanent by AB 976 from January 1, 2024). For a junior ADU, owner-occupancy can be required only if the JADU shares a bathroom with the main house (Gov. Code § 66333, as amended by AB 1154 effective January 1, 2026).

What is the maximum size of an ADU in California?

1,200 sq ft for a detached or attached ADU. 500 sq ft for a JADU. For garage conversions, the full garage footprint can be converted regardless of size.

How quickly must the city approve my ADU permit in California?

Within 60 days of a complete application submission. If the city fails to act, the permit is deemed approved by operation of law. APLA submits complete, accurate applications to maximize the chance of on-time approval.

Building outside Los Angeles County? APLA is licensed statewide (CA Lic #1136359) and also builds in Ventura County — Thousand Oaks, Simi Valley, Camarillo, Oxnard — and Orange County — Irvine, Anaheim, Huntington Beach, Newport Beach. The entitlement rules are state law and travel with you; what changes is which building department reviews the plans.

What about utility connections? Utility connections are the most under-budgeted part of an ADU project, and the rules differ sharply between a conversion and a new detached build — including whether a separate connection can be required at all.
